Eccentric Supreme Court and Its Whimsical Judgments

supreme-court In one of its whimsical judgments, Supreme Court of India has promulgated that state governments do not have any right to appeal in the cases being investigated by CBI (Central Bureau of Investigation). As per the judgment, the right to appeal against the judgment passed by special CBI courts rests exclusively in the hands of central government.

The Apex court has robbed state government of its power to appeal against any judgment passed by special court in cases being probed by CBI. This ruling may have brought big smile on Lalu Yadav’s face, but it made me frown.

What are the implications of this ruling?

For one thing, the judiciary will become more corrupt.

Well, I believe you do not believe in the fable of “incorruptible judiciary”. And do we need to remind ourselves how dysfunctional our legal system is?

If you believe, the dysfunction of the judiciary is mere the problem of system and not corruption then ask yourselves how Judges amass so much wealth. In the lower courts, lots of cases are settled on a bottle of whiskey, a plate full of chicken, and wads and wads of cash.

How often have you heard a poor person winning the case against an affluent person?

I challenge you to recall even an incidence where this had happened.

By taking away the right to appeal in the apex court, the Supreme Court has unknowingly provided fodder to already-corrupt judiciary. Buying or threatening judges on the lower level is easier than it is on the upper level. This rule will give more incentive to special courts to end the case then and there. And in most of the cases, the verdict will not be challenged by the Center in the Supreme Court.

This is how justice will be done.

What kind of cases CBI handles?

If you want to know who will benefit from this judgment, you should focus on the cases that CBI looks after, and also on people whose destiny these cases decide. Most of the cases probed and investigated by CBI involve people in power. And do I need to tell, how far they can go to get the verdict in their favor from lower courts?

I would suggest the Supreme Court to consider the implication of the judgment it passes, before proclaiming any judgment. A view of the larger picture is necessary.

My Reply to Abusive Commenter on Nitish Kumar – A Monkey Business

By writing post titled, It’s All Monkey Business for Nitish Kumar, I think I have agitated quite a few Nitish Kumar Supporters. I have received abusive comments on the post, which I duly marked spam. I would request you to read the following declaration before writing any more abusive comment:

    1. I have no business with Mr. Lalu Prasad Yadav. I know what he has done for Bihar, and I also do not want him to be back in power as much as you do (or even more), but I know the decency to not be abusive in comments.
    2. The kinds of abuses you have thrown at me show the kind of people you are surrounded with, so we should better use some kind words to reflect our good upbringing. At least mine is good one.
    3. Does Nitish Camp has any decent person to start healthy discussion on the topic?
    4. By not being in favor of MR. Lalu Yadav does not make me a Nitish Pro. Nitish is no better, at least in terms of failed promises.
    5. I am not willing to buy into the “Bihar development and his being honest” propaganda spread by his own PR team (I hope those who wrote abuses know what PR firm does).

      I think, instead of being pro this and anti that, you need to think on the terms of development in the state and condition of people in the state. Go and find the data and do a comparative analysis of things that has changed, and how Mr. Kumar has used laws to cover up for his incompetence. We need a competent CM, not someone who cannot do anything. The image of Mr. Kumar that you have now is PR generated.

      Why don’t you exercise your mind and see what is right and what is not? Don’t fall for PR campaigns. It will do not any good to you or society. I definitely do not want RJD or Mr. Yadav, but it does not mean I am stuck for Mr. Kumar only.

      Be it Nitish Kumar if that is only option we have. But do not give up before exercising your judgment.

      It’s All Monkey Business for Nitish Kumar

      Bihar-failed-stateNitish Kumar, the Chief Minister of Bihar, has wonderfully dealt with a minister who put “Scam charges” on his own department and CM’s secretariat. He has sacked his Excise minister Jamshed Ashraf for speaking truth.

      This is how our great CM is trying to revive a failed state: by firing anyone who speaks against his government and its bureaucrats.

      If Nitish Kumar was not involved in the scam- yes I wrote SCAM and his involvement in it- then Mr. CM should have sent the matter for higher investigation (probably CBI),  but instead he asked chief secretary of state (another bureaucrat) to investigate the charges Mr. Ashraf put against Bureaucrats in Nitish’s office.

      How innocent is the CM! It’s time for us to think afresh of all the development gaga he is making for Bihar. This whole “Bihar developing” sounds more like NDA’s “India shining” — a Public relation campaign— and by the way Bihar has the same government who shouted “India shining” before 2004.

      How good will you rank a government that has only helped in constructing state’s road in 5 years (1,825 days)? That too is not complete!

      Facts about Bihar

      • If you have lost your driving license or mobile phone, you will have to pay Rs. 600 to Bihar police to make them register your FIR.
      • If you have been beaten or attempted to set you on fire alive by your in-laws or even escaped from certain death then you will have to pay Rs. 10,000 to make Bihar Police register your FIR.
      • There is no way in which you can make police do anything without paying any money. If you know someone in power than at least you will have to pay for Police’s chai paani and cigarette. (Rs. 100 at least).
      • No electricity in any city for more than 8-10 hours a day (except perhaps Patna) despite tall claims of building this grid system, and producing that much electricity there.
      • Teacher to student ratio is dangerously low.
      • Government is treating employment as opium for Bihari masses not as something they should get, hence offering them petty jobs to keep them busy by paying just Rs. 5,000 at max. I am being very generous when I said so. By design government is pushing Biharis towards poverty line.
      • Nitish Kumar is all words and no action CM. He failed even to bring one company, forget about industry to Bihar.
      • There are quite a few sugar mills, paper mills, and other old establishment in the state which is not operational. Mr. Kumar never bothered to take notice of any of them.
      • It is not unknown to anyone that Bihar has a rich cultural history, which government has failed to capitalize it through tourism.
      • Bihar has also failed to capitalize on religious tourism. Well even I am not a big fan of god still I believe this should have been used to pull pilgrims to Bihar.
        • For Sikh: Patna Sahib, Birth Place of Guru Gobind Singh, which in its own right could be a good crowd puller.
        • Buddhist: Bodh Gaya, place where Buddha got Nirvana. For Buddhists even vaishali is very important.
        • Jains: Jamui, birth place of Mahavira who establish Jainism had a potential of becoming a destination for Jain pilgrims, which it is not
        • Hindu: Mithila (Darbhanga, Sitamadhi, etc.) the birth place of Sita could have been used to pull Hindu pilgrims.
      • There are several failed industry and economic sectors in Bihar that Nitish Kumar simply overlooked. They could have doubled the growth of the state.

        Like India of 2004, Bihar is also not shining. It is for us to wake up to this fact and work towards a change, I mean the real one.

        Why are you mourning 26/11?

        26/11 (Mumbai Attack) – Everyone is celebrating (no one is mourning or is bereaved) 26/11. Why is it so important? Why government, media, and people are so mournful about victims of 9/11? What is so different about 9/11?

        And how that incident was worse than what happened in Sarojni Nagar, Pahar Ganj, Surat, Hydrabad, mahipalpur and in countless other places? Why do we need to do MEMORIAL SHIT for this one incident…?

        We are hooked to 26/11 because that is the single incident in which collective asses of rich and famous got kicked. They felt the blow, that is why there is so much of hue and cry about 26/11.

        Why are we disrespecting the lives of everyone else who died in countless terror strikes, famines, train accidents, riots, and because of countless wrong decisions taken by the government?

        Sometimes I feel, I should be happy about what happened on 26/11 and do not give a second thought about the rich and famous who died in Taj Hotel. Millions of people are dying and countless millions suffering every single day. Let’s not be blind and fight the battle that we have to.

        It’s all monkey business for media, politicians, and those who were trapped in Taj Hotel on 26/11.

        Obama: A World Leader in the Making?

        A couple of months back, I wrote this sample article for one of my clients. As this was just a sample for which neither the payment was made nor the copyright was sought. Hence, the decision to publish it on my blog or not rested with me. Today, while browsing through my folders, I happen to see this article, and I thought to publish the article here. I believe, this will be an interesting read for my readers.

        obama-100-daysMartin Luther king Jr. had a dream and Barak Obama has realized it. He said he can and America supported him, and so did the rest of the world. He swore as 44th president of the United States, and everyone watched him glued to the television. It was a proud moment, and we held our head high and fixed our gaze at the top-most invisible point in the horizon. It has been hundred days since and the time for a reality check has come.

        How do you perceive Barak Obama? Is he a leader of American people who voted for him; is he a world leader with American interest in mind, or is he a true leader of men and women of all class, creed, race, and ethnicity? How you answer this question will decide how you will evaluate the work done by Obama in his first hundred days in the oval office. Through his debates and speeches, he pitched himself as a true leader of men and women, regardless of their birth, and location, so through this article I will analyze his works in this light only.

        As a true world leader, Obama has fallen short of his promises on many occasions. If his announcement of closing the Guantanamo Bay prison within one year has set the stage for him to become a true world leader then his myopic South-East Asian policy has given one of the biggest dents in his world-leader image. Neither of the two got wide acceptance, but the former was seen by supporters as a step towards bringing fairness in trail and as a step that recognizes the prisoners’ human rights. His declaration of deploying more troops in Afghanistan by 2011 raised many eyebrows, and his strategy towards handling crisis in Pakistan is seen as half-hearted measure to crush international terrorism. This Af-Pak policy is neither going to curb the extremists’ intention to take over Pakistan, nor this policy will succeed in breaking the backbone of Taliban and Al-Qaeda.

        While drafting the Af-Pak policy his administration’s officials forgot to take into account the recent Talibanisation of Western Pakistan. They also misread the survey reports that conveyed the support Osama Bin Laden has in Pakistan. Obama with his lenient stance towards Pakistan has paved a way for Taliban to take control of Islamabad, which will not be even in the United States’ own interest.

        There are similar loopholes in the Obama’s foreign policy that only will not pose a threat to the United States leadership, but a strong and unrestrained North Korea, Iran, and Venezuela will also be a threat of equal measure for the world peace.

        In his first 100 days in the office, Obama has proved to be a strong leader with clear concern for the American tax payers, who happen to vote for him, but Obama still has many things to prove in order to become a true leader of men and women.
